Florida Attorney General announces arrest of drug trafficker previously released under federal autopen commutation

Miramar, Florida – Florida Attorney General James Uthmeier, alongside FBI Deputy Director Andrew Bailey, announced the arrest of James Howard Dobbs Jr., also known as “Red,” a convicted felon and repeat drug trafficker whose federal prison sentence was previously commuted in the final days of the Biden Administration through an autopen authorization. The announcement, made in Hollywood, Florida, marks what state officials describe as a renewed push for accountability through closer coordination between state and federal law enforcement agencies.

Dobbs, who served only 20 months of a seven-year federal sentence, is now back in custody and facing a new set of state charges under Florida law. Officials say the case reflects a broader effort to revisit certain federal clemency decisions and pursue prosecution at the state level where applicable.

Attorney General Uthmeier sharply criticized the prior commutation, linking it to broader concerns about public safety.

“Joe Biden’s autopen freed dangerous criminals and put Florida families at risk, but with FBI Director Patel’s and Deputy Director Bailey’s leadership, we are entering a new era of cooperation between federal and state law enforcement.” said Attorney General James Uthmeier. “Thanks to our strong partnership, we are correcting another egregious wrong. If you are a felon in Florida whose sentence was erased by autopen, our prosecutors make sure you face the accountability you earned.”

FBI Deputy Director Andrew Bailey echoed those remarks, emphasizing the importance of accountability and the role of law enforcement cooperation in pursuing violent offenders.

“An autopen should never have more power than justice,” said FBI Deputy Director Andrew Bailey. “Today, the FBI and the State of Florida are proving that violent offenders cannot evade accountability. We will pursue every lawful avenue to ensure justice is served and victims are never forgotten.”

Florida Department of Law Enforcement Assistant Commissioner John Vecchio also highlighted the agency’s role in supporting the investigation and ensuring public safety.

“FDLE’s mission is to promote public safety and strengthen domestic security. We take this mission seriously,” said FDLE Assistant Commissioner John Vecchio. “The safety and security of citizens and visitors is our top priority. If you commit a crime in Florida, our FDLE agents and analysts will use every available resource to investigate those crimes and bring you to justice.”

According to law enforcement officials, the case against Dobbs began between March and June 2023, when he became the subject of an FBI-led investigation in Brevard County. A confidential source identified him as a drug distributor operating in the area, prompting undercover operations and controlled purchases.

Investigators say Dobbs repeatedly sold trafficking-level quantities of MDMA and cocaine during several monitored transactions. These purchases formed the basis of federal charges that would later lead to a search warrant and arrest.

On June 27, 2023, federal agents executed a search warrant at Dobbs’ residence in Cocoa. Inside the home, officers recovered approximately 305.6 grams of MDMA, which Dobbs allegedly attempted to flush down a toilet during the raid. Authorities also found a loaded Taurus .40 caliber firearm with a round chambered, located on his nightstand beneath a business phone, along with additional quantities of cocaine in the bedroom.

Officials say the discovery of both narcotics and a firearm strengthened the case against Dobbs, particularly given his status as a convicted felon prohibited from possessing weapons.

During a post-Miranda interview, investigators report that Dobbs admitted ownership of the firearm and acknowledged he was legally barred from possessing it due to his prior felony record. He also admitted that the MDMA and crack cocaine belonged to him and stated that he sold the substances that were seized during the investigation.

Dobbs was charged by information on a long list of felony counts related to drug trafficking and firearms possession. The charges include multiple counts of trafficking in phenethylamines, trafficking in cocaine, possession of cocaine, and felonious possession of a firearm.

Several of the trafficking counts carry mandatory minimum sentences of three years, while one count involving a larger quantity of phenethylamines carries a mandatory minimum of seven years. In total, Dobbs faces exposure to up to 320 years in the Florida Department of Corrections if convicted on all counts.

The charges are broken down into 12 separate counts, including five counts of trafficking in phenethylamines at lower thresholds, multiple cocaine trafficking counts, and one higher-level trafficking charge involving 200 to 400 grams of controlled substances.

State officials emphasize that the combination of repeated drug sales, large-scale quantities, and firearm possession reflects what they describe as a serious public safety threat.

Dobbs is currently being held in Brevard County while awaiting further court proceedings. His case is being prosecuted under a cross-designation agreement involving Chief Assistant Statewide Prosecutor Paul Dontenville and Assistant Statewide Prosecutor Jessica Baik, working in the Eighteenth Judicial Circuit of Florida in coordination with the Office of State Attorney William Scheiner.

Officials say the cross-jurisdictional structure allows state and federal authorities to pursue overlapping legal strategies in cases involving major drug trafficking operations.

Law enforcement leaders describe the arrest as part of a broader effort to ensure that individuals previously released from federal custody under disputed or unusual circumstances are still held accountable under state law where evidence supports additional prosecution.

As the case proceeds, Dobbs faces significant potential prison time, and officials say further updates will be provided as the legal process continues through Florida’s court system.

For now, state leaders maintain that the arrest underscores their commitment to aggressive prosecution of drug trafficking offenses and reinforces their message that violent or repeat offenders will not escape scrutiny, regardless of prior federal sentencing decisions.
